(Minghui.org) Ms. Liu Guiying, a senior engineer from the 29th Institute of Electronic Information Corporation in Chengdu City, Sichuan Province, has been detained in the Chengdu Detention Center for one year and eight months. The Procuratorate submitted her case to the Jinniu District court 11 months ago, yet the case is still not in the court case management system.

Ms. Liu's attorney pointed out that based on the evidence, there is no legal basis to prosecute her. Furthermore, she has been detained for far over the legal limit. According to Article 96 of the Criminal Procedure Law, the authorities should immediately release her.

Arrested For Exercising Her Right to Sue

Ms. Liu has been arrested, tortured, and sent to a labor camp because she practices Falun Gong. She filed a criminal complaint against former Chinese leader Jiang Zemin, who started the persecution of Falun Gong in 1999. She was subsequently arrested at home on November 25, 2015, by police officers from the Chadianzi Police Station. Her home was also ransacked.

Attorney Repeatedly Requests to Cancel the Case

Ms. Liu's attorney has tried to communicate with officials in charge of the case to no avail. Police officer Gan Yiwei eventually told the attorney that he was just an assistant, and that the case was controlled by the local 610 Office.

The Procuratorate returned the case to the police twice due to insufficient evidence. Ms. Liu's attorney submitted letters proposing non-prosecution twice to the Procuratorate in May 2016. He pointed out that the evidence collected through home ransacking is illegal and could not be used as evidence.

Ren Lijun from the Procuratorate did not respond to the attorney directly. Instead, he said the indictment was their collective decision.

Attorney Requests Ms. Liu’s Release

The Procuratorate submitted the case to the Jinniu District Court on August 22, 2016, but 11 months later, the case still has not been entered into the court’s case management system. No case number could be found, which violates legal requirements. Meanwhile, Ms. Liu has been detained far over the legal limit.

Wu Yao, who was in charge of the case, told Ms. Liu's attorney on September 27, 2016, that this was a special case, and that they submitted the case to the Chengdu Intermediate People's Court for instructions. He said they are waiting for a response.

When the attorney asked about the case on February 6, 2017, Li Li, who is in charge of the case said that it was still being evaluated.

The attorney requested on February 6, 2017 that the court release Ms. Liu, but the court did not respond.

The attorney pointed out it is illegal to treat cases related to Falun Gong practitioners as special cases, and that this is an example of improper implementation of the law. He emphasized that Ms. Liu should be released immediately.

Yu Hui, then head of Chengdu City Anti-cult Office (an extra-judicial agency tasked with persecuting Falun Gong), was responsible for ordering the arrest of Ms. Liu and many other Chengdu practitioners.
